Terms of Service

These Terms of Service ("Terms") are entered into between you and GotNext LLC, a Delaware limited liability company ("GotNext," "we," "us," or "our"). These Terms govern your access to and use of the GotNext website located at gotnext.gg (the "Platform"), including any content, functionality, and services offered on or through the Platform.

By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

1. Eligibility

General Access

You must be at least 13 years old to create an account and use the Platform's free features, including participating in free tournaments and ladders. By using the Platform, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Platform.

Cash Match, Wallet, and Paid Competition Features

To access cash matches, digital wallet features, paid tournaments, or any features involving real money transactions, you must be at least eighteen (18) years old. By accessing these features, you represent and warrant that you are at least 18 years of age. We may require age verification at any time and may request proof of age before processing any withdrawal.

Geographic Eligibility

Free competitions are open to legal residents of the fifty (50) United States, Washington D.C., and Canada who meet the age requirements above.

Paid competitions, cash matches, and wallet features are NOT available to residents of, or persons participating from, the following jurisdictions:

• Arizona
• Hawaii
• Iowa
• Mississippi
• Montana
• Nevada
• South Dakota

We reserve the right to request proof of residency and to terminate accounts that do not meet eligibility requirements.

2. Account Registration

To access certain features of the Platform, including tournaments, ladders, and cash matches, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account
• Use only one account per person

Participation in tournaments, ladders, and cash matches requires linking external gaming accounts (e.g., Xbox, PlayStation, Steam, Discord). You are responsible for ensuring your linked accounts are in good standing and comply with their respective terms of service.

To be eligible to receive prizes or withdraw funds, you must be the registered owner of the email address identified in your account. Participation from an email address other than your own is void. Should there be a dispute regarding the identity of any winner, the winner shall be the person in whose name the email account was opened.

3. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Cheat, exploit bugs, or use unauthorized software in any competition
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Interfere with or disrupt the Platform or servers
• Use the Platform to distribute spam, malware, or other harmful content
• Create or use multiple accounts
• Participate in any form of collusion, match-fixing, or win trading
• Use any robot, spider, scraper, or automated means to access the Platform
• Attempt to reverse engineer, disassemble, or decompile any part of the Platform

We reserve the right to suspend or terminate accounts that violate these Terms or engage in conduct we deem harmful to the community.

4. User Content

The Platform allows you to upload content, including profile pictures, team logos, and other materials ("User Content"). You retain ownership of your User Content, but by uploading it to the Platform, you grant GotNext a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the Platform.

You represent that you own or have the necessary rights to your User Content and that it does not violate any third party's intellectual property or other rights.

We reserve the right to remove any User Content that violates these Terms or that we find objectionable at our sole discretion.

5. Skill-Based Competition

GotNext is a platform for skill-based video game competition. The outcome of all matches, tournaments, and competitions is determined entirely by player performance and skill, not by chance.

GotNext does not offer gambling services. Credits have no cash value and cannot be withdrawn or converted to cash. Participation in cash matches and paid tournaments constitutes entry into skill-based competitions, not gambling or wagering.

You are responsible for understanding and complying with the laws of your jurisdiction regarding skill-based competitions for prizes.

6. Digital Wallet System

GotNext uses a dual-wallet system to manage funds on the Platform. Your account contains two separate balances with distinct purposes and rules.

Cash Balance

Your Cash Balance contains real money deposited via approved payment methods (such as PayPal or Skrill). Cash Balance funds are denominated in US dollars (USD).

• Purpose: Cash Balance is used exclusively for cash match entry fees.
• Deposits: You may add funds to your Cash Balance using approved payment methods displayed on the Platform.
• Withdrawals: Cash Balance funds are withdrawable, subject to the withdrawal requirements in Section 10.
• Winnings: Cash match winnings are added to your Cash Balance and are immediately withdrawable (subject to Section 10 requirements).

Credits Balance

Your Credits Balance contains purchased credits used for tournament entry. Credits are denominated in US dollars (1 credit = $1 USD) for convenience but have no cash value.

• Purpose: Credits are used exclusively for tournament entry fees.
• Purchases: Credits may be purchased using approved payment methods displayed on the Platform.
• No Cash Value: Credits have no cash value, are non-refundable, and cannot be withdrawn, transferred, or converted to cash under any circumstances.
• Non-Transferable: Credits cannot be transferred between users or between your Cash Balance and Credits Balance.

Important Distinctions

Balance Expiration

Neither Cash Balance nor Credits expire while your account remains in good standing. If your account is terminated for Terms violations, any remaining balances may be forfeited.

Prohibited Uses

You may not use the wallet system to:

• Transfer money or credits between users outside of legitimate competition
• Launder money or engage in any fraudulent activity
• Circumvent withdrawal requirements
• Exploit system errors or vulnerabilities
• Use the Platform as a money transfer or payment service

Violations may result in account termination and forfeiture of all balances.

7. Cash Matches

Overview

Cash matches are skill-based, head-to-head competitions where users compete for real money prizes. The outcome of all matches is determined entirely by player skill, not chance. Cash matches use your Cash Balance (not Credits).

Eligibility

You must be at least 18 years old and located in an eligible jurisdiction to participate in cash matches. By participating, you represent and warrant that you meet these requirements.

Match Creation and Entry

Users may create cash matches by selecting an entry amount and match rules. The entry amount is deducted from your Cash Balance when creating or accepting a match. Both players must have sufficient Cash Balance to cover the entry amount.

Match Rules

All participants must abide by the specific rules set for each match. Matches must be played fairly using standard game settings unless otherwise specified. Recording gameplay is strongly recommended and may be required for dispute resolution.

Result Reporting

Both players must report the match result. If both players agree on the outcome, the match is completed and the winner receives the prize pool minus the platform fee. If players disagree, a dispute is created.

Platform Fee

GotNext charges a platform fee on cash matches. The current fee is 10% of the total prize pool, deducted from the winner's payout. Fee rates are subject to change with notice.

Winnings

Cash match winnings are added to your Cash Balance. Winnings are immediately withdrawable, subject to the requirements in Section 10.

Match Cancellation

Match creators may cancel open matches that have not been accepted. Once a match is accepted, it may only be cancelled by mutual agreement or by platform administrators. Cancelled matches result in full refunds to both parties' Cash Balances.

Match Expiration

Open matches that are not accepted within the specified time period will automatically expire and the creator's entry will be refunded to their Cash Balance.

8. Tournaments and Competitions

Participation

Participation in tournaments and ladders is subject to specific rules posted for each event. By entering a tournament, you agree to abide by those rules. Paid tournament entry fees are paid using your Credits Balance (not Cash Balance).

GotNext reserves the right to:

• Disqualify participants for rule violations, cheating, or unsportsmanlike conduct
• Modify, cancel, or postpone tournaments at any time
• Make final decisions on all disputes

Tournament eligibility, structure, and prizes (if any) will be communicated prior to each event. Failure to comply with tournament rules may result in disqualification and/or account suspension.

Tournament Prizes

Tournament prizes, if any, are distributed as specified in each tournament's rules. Cash prizes from tournaments are added to your Cash Balance and are withdrawable subject to Section 10.

Tournament Hosting

Users may create and host tournaments on the Platform. As a tournament host, you agree to:

• Provide accurate and complete tournament information
• Moderate your tournament fairly and in accordance with stated rules
• Comply with all applicable laws regarding competitions and prize distribution
• Respond to participant inquiries and disputes in a timely manner
• Not use the hosting feature for fraudulent or deceptive purposes

GotNext reserves the right to remove tournaments or suspend hosting privileges for violations of these Terms.

9. Disputes

Dispute Process

When players disagree on a match result, a dispute is automatically created. Both players will be prompted to submit evidence, including video recordings (VODs) of the match.

Evidence Requirements

Players are responsible for recording their matches. Video evidence is the primary factor in dispute resolution. Failure to provide evidence when requested may result in a ruling against you.

Resolution

GotNext administrators will review all available evidence and make a final determination. Administrator decisions are final and binding. Disputes are typically resolved within 24-48 hours.

Priority Support

Users may purchase priority support when creating or accepting a match for an additional fee. Priority support ensures faster dispute resolution and dedicated administrator attention.

False Reporting

Deliberately false result reporting is a serious violation. Users who falsely report match results may face:

• Immediate account suspension
• Forfeiture of all balances
• Permanent ban from the Platform

10. Withdrawals

Eligibility

To request a withdrawal from your Cash Balance, you must:

• Be at least 18 years old
• Have a verified account in good standing
• Have a Cash Balance meeting the minimum withdrawal threshold
• Have completed at least three (3) cash matches or paid tournaments
• Have an account that is at least seven (7) days old
• Be located in an eligible jurisdiction

Minimum and Maximum Withdrawals

The minimum withdrawal amount is $10 USD. Daily withdrawal limits may apply and are displayed in your account settings.

Withdrawal Fees

Withdrawals are subject to processing fees. Current fees are displayed at the time of withdrawal request. Fees vary based on withdrawal method.

Processing Time

Withdrawal requests are reviewed and processed within 3-5 business days. GotNext reserves the right to request additional verification before processing withdrawals.

Withdrawal Methods

Available withdrawal methods are displayed in your account. You are responsible for providing accurate payout information. GotNext is not responsible for funds sent to incorrect accounts due to user error.

Right to Review

GotNext reserves the right to review any withdrawal request and may delay or deny withdrawals if we suspect fraud, Terms violations, or other prohibited activity. We may require identity verification, including government-issued identification, for any withdrawal.

Affidavit of Eligibility

As a condition of receiving any withdrawal or prize over $100, you may be required to provide an affidavit or declaration of eligibility in form and substance satisfactory to GotNext within fifteen (15) days of our request. Failure to provide such documentation may result in forfeiture of the withdrawal or prize.

11. Prohibited Activities

In addition to the general prohibited conduct in Section 3, the following activities are strictly prohibited:

Collusion

Coordinating match outcomes with other users, including intentionally losing matches, win trading, or any form of match manipulation.

Money Transfers

Using the Platform to transfer money between users outside of legitimate competition. GotNext is not a money transfer service.

Multi-Accounting

Creating or using multiple accounts to manipulate matches, circumvent bans, abuse promotions, or for any other purpose.

Fraud

Any attempt to defraud GotNext or other users, including but not limited to:

• Chargeback fraud
• Providing false identity information
• Exploiting system errors
• Using stolen payment methods
• Identity theft

Consequences

Violations may result in:

• Immediate account suspension
• Wallet freeze
• Forfeiture of all balances (both Cash Balance and Credits)
• Permanent ban from the Platform
• Reporting to law enforcement where applicable
• Civil action to recover damages

12. Prizes and Tax Obligations

Prize Distribution

Some tournaments and cash matches offer prizes. Prize details, eligibility requirements, and distribution methods will be specified for each event.

Tax Reporting

It is your obligation (not GotNext's) to pay all taxes imposed upon you or upon any prizes you receive. You are responsible for preparing and filing all tax returns and reports required by your jurisdiction.

For prizes or withdrawals totaling $600 or more in a calendar year, GotNext is required by law to collect your tax information (including Social Security Number or Tax ID) and file IRS Form 1099-MISC. By participating in cash matches or tournaments with prizes, you agree to provide accurate tax information upon request.

GotNext reserves the right to withhold prizes or withdrawals from any participant who:

• Violates these Terms or applicable competition rules
• Fails to provide required tax information within thirty (30) days of request
• Is located in a restricted jurisdiction

13. Payments and Fees

Platform Hosting Fees

Tournament hosts are charged a platform fee for using GotNext's tournament hosting features. Current fees are displayed during tournament creation and are subject to change with notice. By creating a tournament, you agree to pay all applicable platform fees.

Payment Processing

Payments are processed by our third-party payment processors, including PayPal and Skrill. By making payments through the Platform, you agree to be bound by the applicable payment processor's terms of service and privacy policy. GotNext does not store your complete payment card information—this data is securely handled by our payment processors.

Billing

Platform fees are charged at the time of tournament creation. Credit purchases and Cash Balance deposits are charged at the time of purchase. You agree to pay all fees and charges incurred in connection with your use of the Platform.

Currency

All fees, balances, and prizes are denominated and processed in United States Dollars (USD).

Failed Payments

If a payment fails or is declined, we may prevent tournament creation, credit purchases, or cash deposits until the payment issue is resolved. Repeated payment failures may result in account restrictions.

Chargebacks and Disputes

If you believe a charge is incorrect, please contact us at support@gotnext.gg before initiating a chargeback with your bank. Initiating a chargeback without first attempting to resolve the issue with us will result in immediate account suspension and may result in permanent ban and forfeiture of all balances.

14. Refund Policy

This section outlines our refund policies for all transaction types on the Platform.

Cash Balance Deposits

Cash deposits to your Cash Balance are refundable within fourteen (14) days of deposit, provided:

• No cash matches have been played using those funds
• The funds have not been used in any competition
• Your account is in good standing

Once funds from a deposit have been used in any cash match (win or lose), those funds are no longer eligible for refund. Winnings from cash matches are not refundable.

Credits Purchases

Credits purchases are final and non-refundable. Credits have no cash value and cannot be refunded, withdrawn, or converted to cash under any circumstances. By purchasing credits, you acknowledge and agree that all credit sales are final.

Tournament Entry Fees

Some tournaments require entry fees paid via Credits. For team tournaments, each player pays their individual entry fee: the team captain pays when registering the team, and team members pay when accepting their invitation.

Tournament entry fee refunds are handled as follows:

• 48+ hours before tournament start: You may withdraw from a tournament and receive an automatic full refund of your entry fee (as Credits) if the tournament has not started and there are at least 48 hours until the scheduled start time.
• Within 48 hours of tournament start: No automatic refund is available. You must submit a support ticket for refund consideration.
• Incomplete teams: If your team does not meet the minimum roster size by the registration deadline, all paid members receive automatic full refunds when the team is automatically withdrawn.
• Tournament cancelled by GotNext: If GotNext cancels a tournament before it begins, entry fees will be refunded (as Credits) to all registered participants.
• Disqualification: Entry fees are non-refundable if you or your team is disqualified for rule violations.

Cash Match Entry

Cash match entries are refundable only in the following circumstances:

• Match not accepted: If you create a match and it expires without being accepted, your entry is automatically refunded to your Cash Balance.
• Match cancelled by mutual agreement: If both players agree to cancel a match before it is played, both entries are refunded.
• Match cancelled by administrators: If GotNext administrators cancel a match due to technical issues or rule violations by your opponent, your entry may be refunded at our discretion.

Once a cash match has been played and a result submitted, entries are not refundable regardless of the outcome.

Platform Hosting Fees

Platform hosting fees for tournament creation are generally non-refundable once a tournament has been created. Refunds may be considered on a case-by-case basis for significant technical issues caused by the Platform that prevented the tournament from occurring.

How to Request a Refund

To request a refund for eligible transactions, contact us at support@gotnext.gg within fourteen (14) days of the transaction. Include your account email, transaction details, and reason for the refund request. Refund requests are reviewed within 5-7 business days.

Refund Method

Approved refunds for Cash Balance deposits will be returned to the original payment method when possible. Credit refunds (for tournament entries) are returned as Credits to your account. Processing times vary by payment method and may take 5-10 business days to appear in your account.

15. Communications and Privacy Expectations

No Expectation of Privacy

Communications made using the Platform, including chat messages, match communications, and any other user-to-user communications, should not be considered private. You acknowledge and agree that you have no expectation of privacy concerning the transmission of any communications through the Platform.

Because communications may be viewed by other users or Platform administrators, you should avoid revealing personally identifiable information such as your real name, address, phone number, or financial information in chat or match communications.

Platform Communications

By creating an account, you consent to receive communications from GotNext, including service announcements, administrative messages, and promotional materials. You may opt out of promotional communications at any time.

16. Intellectual Property

Platform Ownership

The Platform and its original content, features, and functionality are owned by GotNext and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our prior written consent.

Limited License

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes, subject to these Terms. This license does not include the right to:

• Resell or commercially use the Platform
• Modify or create derivative works
• Use data mining, robots, or similar data gathering methods
• Download or copy account information for another party's benefit

Third-Party Intellectual Property

GotNext features tournaments and competitions for games owned by third parties. All game titles, logos, and related imagery are the property of their respective owners. GotNext is not affiliated with, endorsed by, or sponsored by Microsoft, The Coalition, or any other game publisher unless explicitly stated.

DMCA Compliance

GotNext respects the intellectual property of others. If you believe your work has been copied in a way that constitutes copyright infringement, please send a notification to support@gotnext.gg containing:

1. A physical or electronic signature of the copyright owner or authorized agent
2. Description of the copyrighted work claimed to be infringed
3. Description of where the infringing material is located on the Platform
4. Your contact information (address, phone number, email)
5. A statement that you have a good faith belief the use is not authorized
6. A statement under penalty of perjury that the information is accurate

Counter-Notice: If you believe content was removed in error, you may submit a counter-notice containing: your signature, identification of the removed content, a statement of good faith belief, your contact information, and consent to jurisdiction in Delaware.

17. Binding Arbitration and Class Action Waiver

These provisions apply to you if you are domiciled in and/or use the Platform in the United States or Canada.

Initial Dispute Resolution

GotNext's support team is available to address any concerns you may have. Most concerns are quickly resolved through informal communication. The parties shall use their best efforts to settle any dispute through consultation and good faith negotiations, which shall be a precondition to either party initiating a lawsuit or arbitration.

Binding Arbitration

If the parties do not reach an agreed-upon solution within thirty (30) days from the time informal dispute resolution is pursued, then either party may initiate binding arbitration as the sole means to formally resolve claims.

All claims arising out of or relating to these Terms, the parties' relationship, and/or your use of the Platform shall be finally settled by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules.

The arbitrator shall have exclusive authority to resolve all disputes, including any claim that all or any part of these Terms is void or voidable. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

Location

For residents of the United States, arbitration will take place at any reasonable location convenient for you. For residents outside the United States, arbitration shall be initiated in Delaware, and you agree to submit to the personal jurisdiction of courts in Delaware to compel arbitration or confirm awards.

Class Action Waiver

THE PARTIES AGREE THAT ANY ARBITRATION SHALL BE CONDUCTED IN THEIR INDIVIDUAL CAPACITIES ONLY AND NOT AS A CLASS ACTION OR OTHER REPRESENTATIVE ACTION. The parties expressly waive their right to file a class action or seek relief on a class basis.

YOU AND GOTNEXT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

If any court or arbitrator determines that the class action waiver is void or unenforceable, then the arbitration provision shall be deemed null and void and the parties shall be deemed to have not agreed to arbitrate disputes.

Exception: Small Claims and IP Claims

Either party may bring an action in small claims court for disputes within that court's jurisdiction. Either party may also seek relief in state or federal court for patent, copyright, trademark, or trade secret claims.

Changes to This Section

GotNext will provide sixty (60) days' notice of any changes to this Section. Changes will become effective on the 60th day and will apply prospectively only to claims arising after the 60th day.

18. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, GOTNEXT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We are not responsible for any losses resulting from:

• Unauthorized access to your account
• Technical issues, bugs, or server downtime
• Actions of other users
• Third-party services or linked accounts
• Payment processing errors by third-party processors
• Your violation of applicable laws regarding skill-based competitions

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GOTNEXT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GOTNEXT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

20. Indemnification

You agree to indemnify and hold harmless GotNext and its owners, operators, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of:

• Your use of the Platform
• Your User Content
• Your hosting of tournaments
• Your violation of these Terms
• Your violation of any law or the rights of any third party
• Any content you post or communicate through the Platform

GotNext reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us.

21. Termination

Termination by GotNext

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination for Terms violations:

• Your right to use the Platform will immediately cease
• Any remaining Cash Balance and Credits may be forfeited
• Any pending withdrawals may be cancelled
• Any prizes not yet distributed may be forfeited

Termination by You

You may delete your account at any time through your account settings or by contacting us at support@gotnext.gg. If you terminate your account in good standing, you may withdraw any Cash Balance in accordance with our withdrawal policies, subject to identity verification. Credits cannot be refunded or withdrawn upon account termination.

Effect of Termination

Termination does not affect any rights or obligations that accrued prior to termination. The following sections survive termination: Sections 4, 12, 16, 17, 18, 19, 20, and 22.

22. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any claims not subject to arbitration shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

23. Third-Party Services

The Platform may contain links to third-party websites or services, including payment processors and gaming platforms. We are not responsible for the content, terms, or practices of any third-party services. Your use of third-party services is at your own risk and subject to those services' respective terms.

24. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

For material changes affecting payments, fees, or the arbitration provisions, we will provide at least sixty (60) days' notice before the changes take effect.

25. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.

26. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and any competition-specific rules, constitute the entire agreement between you and GotNext regarding your use of the Platform and supersede any prior agreements.
